1. Introduction
Welcome to Kashi. These Terms of Service ("Terms") govern your access to and use of Kashi's digital bookkeeping services, applications, and website (the "Service"), specifically tailored for small business owners and entrepreneurs in the African market.
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these terms, please do not access or use the Service. Kashi is a product designed to foster financial transparency and growth for informal and formal small businesses.
2. Definitions
- "Account" means the digital environment created by a User to manage business transactions.
- "Business Data" refers to all information, including transaction records, customer details, and inventory lists uploaded by the User.
- "Kashi" refers to the legal entity providing the bookkeeping technology and its authorized representatives.
- "User" means the individual business owner or representative authorized to manage the Kashi account.
3. User Obligations
As a user of Kashi, you represent and warrant that:
- You are at least 18 years of age and have the legal capacity to enter into a binding contract.
- All information provided during registration is accurate and truthful.
- You will maintain the security of your account password and notify us immediately of any unauthorized access.
- You will not use the Service for any fraudulent activities, money laundering, or illegal trade as defined by the laws of your specific jurisdiction within the African Union.
4. Payments & Billing
Subscription Model
Kashi offers both free and premium tiers. Premium features are billed on a monthly or annual basis via local mobile money providers or supported bank cards.
All fees are non-refundable unless otherwise required by local consumer protection laws. Kashi reserves the right to adjust pricing with a minimum 30-day notice to all active users.
5. Data Privacy
We take your business data seriously. Kashi employs industry-standard encryption to protect your financial records. We comply with major regional data protection regulations, including but not limited to the Nigeria Data Protection Regulation (NDPR) and the South African Protection of Personal Information Act (POPIA).
6. Termination
You may terminate your account at any time through the application settings. Upon termination, you will have a 30-day grace period to export your data before it is permanently deleted from our primary servers, subject to our backup retention policies.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles. Any disputes arising from these Terms shall be settled through arbitration in Nairobi, Kenya.
